Introduction and Purpose of the Privacy Statement

The Future, a non-profit association under Belgian law, registered with the Crossroads Bank for Enterprises under number 0797.377.414, with its registered office at Ijzerenpoortkaai 3/23, 2000 Antwerp, Belgium, attaches great importance to privacy and careful handling of the personal data of users and holders of The Future account (hereinafter also referred to as 'Users').

The Future strives to process personal data in a lawful, fair and transparent manner. In this privacy statement, The Future wishes to explain in a clear, transparent, simple and correct manner how The Future handles the personal data that it collects and processes from the Users, regardless of whether The Future collects this data directly or through a third party.

The privacy statement also explains the purposes for which The Future processes the personal data of Users, which categories of personal data are processed, what rights the Users enjoy with regard to their personal data and how they can exercise their rights.

The Future kindly requests you to read this privacy statement carefully so that you are sufficiently informed about your rights and how you can exercise them. If you still have questions or comments, you can always contact The Future.

Personal data

Personal data is any information relating to an identified or identifiable natural person (the term "data subject" is used by privacy legislation). Organisations, such as companies, are therefore excluded from the scope of this privacy statement.

What data can it involve? Personal data such as date of birth, name, address, telephone number and e-mail address.

The processing of personal data, as mentioned above, means, among other things, the collection, storage, use, communication, management and modification of personal data.

Rights in relation to personal data

Legally guaranteed rights

With regard to his or her personal data, Users and/or other data subjects always have various rights, which are legally laid down in the privacy legislation. In this way, The Future guarantees at all times that you can exercise the following rights.

Right of access

The Future will confirm whether personal data will be processed or not. In the event that personal data is processed, Users in question may request access to the personal data and/or an extract of this personal data. If multiple copies are requested, The Future may charge a fee for this.

Right to rectification and/or completion

If the personal data held by The Future is inaccurate or incomplete, Users may request that it be corrected or supplemented. If desired by Users, The Future may inform them about the third parties who have received the inaccurate and/or incomplete information in the past.

Right to restriction

Users can request The Future to stop processing some or all of their personal data in certain situations. If desired by Users, The Future can inform them about the third parties that have received the information in the past.

Right to erasure

Users can request The Future to completely delete their personal data. However, this is limited to those situations where this personal data is no longer necessary for The Future to perform its services. If desired by Users, The Future can inform them about the third parties that have received the information in the past.

Right to object

Users have the right to object to the processing of his/her personal data by The Future, where The Future processes this data on the basis of a legitimate interest in which Users demonstrate that their right prevails over the legitimate interest of The Future, or for the situations where The Future processes this data for marketing purposes.

Right to data portability

Depending on the circumstances, Users may ask The Future to transfer personal data that Users have provided to The Future to a third party of Users' choice or to use them elsewhere. The transferred personal data will be drawn up and transmitted by The Future in a structured, commonly used and machine-readable format.

Follow-up of your request(s)

The Future will always comply with and follow up on requests to exercise your rights, unless there are legitimate grounds that prevent The Future from complying with your request. In such cases, The Future will not be able to comply with your request, or will only partially comply.

Exercising your rights

With any request to exercise your rights, we kindly ask you to be as specific as possible so that we can process and comply with your request more easily. To ensure that we only provide personal data to the right person, we may ask you to confirm your identity. To this end, we may ask you to provide The Future with a photo or a scan of your identity card.

You will receive an answer to your request from The Future within a month. We will do our utmost to fully process your request within this period, but it is also possible that we will ask for a postponement for important reasons.

In principle, every request is free of charge, unless the handling of your request entails a disproportionate administrative burden for The Future. However, we will inform you in advance of any costs, should they be applicable.

All requests for the exercise of the above rights must be made to The Future by contacting The Future in the manner stated in Article 2 of this Privacy Statement.

Why does The Future process your data?

The Future collects and processes the personal data of Users and other persons mentioned above for the following purposes:

  • Answering persons correctly when they come into contact with The Future, for this purpose
    • The Future has a legitimate interest in processing personal data;
  • Improving the operation of The Future's services, processes and applications, for this purpose The Future has a legitimate interest in processing personal data;
  • The performance of the services offered by The Future, as agreed in one or more agreement(s), for this purpose. The Future processes personal data in the execution of the relevant agreement(s);
  • Following instructions from the police and/or the judiciary when they oblige The Future to process data, in short, from a legal obligation.

We also process your data in order to be able to communicate smoothly with you, our User. This can be done in various ways, including mail, e-mail, telephone, desk, events and/or in the The Future application.

What personal data is collected and processed by The Future?

By visiting the website, contacting and/or using the services of The Future, it is possible that The Future may or may not – necessarily – collect and process personal data.

Depending on the relationship with The Future, the following data may be collected and processed:

  • When visiting the website: the IP address of the visitor is temporarily recognized and used (not individually) for the purpose of analysis and optimization of the website, the website also uses some cookies;
  • When contacting The Future: the contact details of the person who contacts The Future directly (telephone number, e-mail address, etc.) are temporarily processed, as well as any identification data (name, The Future account, etc.) that the person communicates The Future during this contact;
  • When applying for a The Future account: the surname, first name, job and telephone number of the representative of the applicant for a The Future account can be collected and processed;
  • When using a The Future account: the Users' surname, first name, date of birth, address, telephone number, nationality, gender, employer, The Future account number and times and location of use of The Future account may be collected and processed.

Processing of special categories of data

The Future dos not processes special data in the context of its activities.

Intern - The Future

The Future takes the necessary measures to ensure that access to personal data, including that of Users, within the organization is limited to those employees who actually need access in the context of their job.

External - third parties

The Future transfers personal data to the following categories of third parties:

  • Terminals and/or organisations that use the services of The Future and to whom, in order to enable access control in practice, personal data is provided in a secure manner;
    • Organisations and/or persons to whom The Future has outsourced certain services and/or functions, such as suppliers of IT systems, software, IT support, destruction of confidential documents, etc.;
  • Organisations and/or individuals that are an integral part of the operation of The Future, such as external consultants and employees;
    • Organizations that provide technology services such as Google (cookies).
  • Collaboration with third parties

In order to offer a high-quality, user-friendly service, it is also possible that The Future cooperates with third parties, who either process data obtained from The Future or collect and process data from the Users themselves, whereby they act as data controller and their services are included in the service of The Future.

In the latter case, with regard to the processing of his or her personal data by this third party, the User should read the applicable privacy policy of this third party, as it will explain the relationship between the User and the controller. After all, The Future only uses the application, without The Future having any say in the collection and processing by this third party.

How long does The Future keep personal data?

As a general principle, The Future does not store the collected and processed personal data any longer than is strictly necessary to achieve the purposes for which the data is collected. In addition, The Future deletes any personal data, without undue delay, when requested by persons.

The personal data of Users with regard to the services of The Future and more specifically the The Future account, will be kept for the entire period that The Future account is active. The data will be stored for two (2) years after the cancellation or the end of the validity period of The Future account.

At the end of the applicable retention period, the personal data will be permanently deleted.

Security of personal data

The Future makes every effort to prevent misuse, loss, unauthorized access and other undesirable actions with the personal data of Users. To this end, The Future takes the necessary and appropriate technical and organizational measures to ensure that the processing operations meet the requirements of national and European legislation. In this way, The Future also ensures the protection of the rights of Users. The Future ensures that these measures are regularly monitored and adjusted where necessary.

Exchange of data outside the EEA

The Future does not transfer personal data to any person or organisation in which case such personal data would leave the EEA. All of The Future's IT infrastructure is also located within the EEA.

The Future may amend this privacy statement from time to time. All updates and changes will be effective immediately upon their posting.
